TERMS AND CONDITIONS

1. The Grounds of Alexandria (Trading) Pty Ltd (‘Promoter’), located at 7a/2 Huntley Street, Alexandria NSW 2015 (ABN: 38 625 114 132), is running this Competition. By entering, each Entrant (‘Entrant’) agrees to these Terms and Conditions.

2. The Competition is open to Australian residents, excluding employees of the Promoter, and their agencies associated with this Competition, as well as their immediate family members. Entrants under 18 years must have prior consent from a parent or legal guardian over the age of 18 years. The consenting adult will also be bound by these Terms and Conditions.

3. The Competition commences at 7:00am (AEDT) on Friday, 24 January 2025 and closes at 10:00pm (AEST) on Sunday, 9 March 2025 (‘Competition Period’).

4. To enter the Competition, Entrants must: (a) dine at The Grounds of Alexandria Cafe, The Garden, or The Potting Shed during the Competition Period, and present their receipt to gain access to the Claris – The Chicest Mouse in Paris laneways; (b) Post a photograph or video of their Claris experience to their personal Facebook or Instagram account as a post or reel, tagging @thegrounds, and using the hashtag #thegroundsofalexandria in the caption.

5. Each entry must be an original photograph or video taken by the Entrant and shared as a post or reel. Stories will not be considered in the judging process. Each Entrant warrants that their entry does not contain or imply any trademarks or copyright material owned (wholly or partially) by a third party, or violate any laws of privacy.

6. Entrants must have permission from any individuals featured in the photograph or video before posting it. Each Entrant is responsible for determining the appropriate permissions or releases for their own entry(ies).

7. Each Entrant will be responsible for complying with the terms of use and the relevant social media platforms.

8. The Promoter reserves the right to disqualify entries that include objectionable content (including but not limited to profanity, nudity, potentially insulting, discriminatory, unlawful, infringing, hateful, pornographic, or sexually suggestive photos, scandalous, inflammatory, or defamatory images).

9. In submitting an entry, the Entrant consents to the publication of their name, social media handle and/or entry onto the Promoter’s website, printed materials, and/or social media accounts without further compensation. Furthermore, the sharing of the Entrant’s content on the Promoter’s website and/or social media accounts does not imply that the Entrant has, or will, be judged a Winner, nor does it exclude them from being selected.

10. Entries that are found to breach these Terms and Conditions will be considered invalid. If an Entrant has been awarded a prize, that prize must be returned to the Promoter. The Promoter, in its sole discretion, may disqualify any Entrant who the Promoter has reason to believe has breached these Terms and Conditions or engaged in unlawful activity or other improper misconduct that jeopardises the fair and proper conduct of the Competition. The Promoter reserves its legal rights to recover damages or other compensation against that Entrant for any breach.

11. The entries will be judged and the Winners of the Competition will be announced on Wednesday, 12 March 2025.

12. There will be three (3) Winners in the Competition, each receiving 1x voucher for AUD$200 worth of Grounds Dollars to spend at The Grounds of Alexandria Cafe, The Garden, The Potting Shed, The Grounds of The City and/or The Grounds Coffee Factory. The vouchers cannot be used for catering, retail, or wholesale purchases or used in relation to an event at The Grounds. Each prize is valid for three (3) years from the date of issue.

13. The prizes are not transferable, exchangeable or redeemable for cash. Prizes will be sent to the Winner’s nominated address as stated in their direct message with the Promoter. The Promoter takes no responsibility for prizes damaged or lost in transit.

14. All valid entries received during the Competition Period will be judged on their merit, which may include, and will not be limited to, the consideration of: (a) originality; (b) creativity, (c) visual appeal; and/or (d) connection to the theme.

15. The Promoter’s decision is final and it reserves the right not to provide any explanation for the award of prizes for the Competition. No correspondence will be entered into regarding the outcome.

16. Each Winner will receive a direct message via their Facebook or Instagram account from the Promoter if they have won a prize and must provide relevant details to claim that prize. If a Winner does not respond within three (3) business days of receiving a direct message and provide all of the requested details, the Promoter reserves the right to withdraw the award of that prize and award it to another entrant.

17. As a condition of entering the Competition and acceptance of any prise, each Entrant agrees: (a) to assign all copyrights or other intellectual property rights in and to their entry, and any related content to the Promoter; (b) that the Promoter has an irrevocable, transferable, and unrestricted right to use their entry in connection with the Promoter’s business without the payment of any compensation; (c) to any documentation the Promoter requires to give effect to this arrangement; and (d) to provide consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1986 (Cth).

18. If for any reason whatsoever beyond the reasonable control of the Promoter, the Competition is not capable of being conducted as reasonably anticipated, including but not limited to tampering, unauthorised intervention, fraud, national disasters, global pandemics, or an other causes beyond the control of the Promoter, the Promoter reserves the right to, in its sole discretion, suspend, modify, or terminate the Competition and/or disqualify any Entrant who tampers with, or is suspected of tampering with, the Competition.

19. Entries that involve fraudulent activity, such as using bots, fraudulent accounts, or AI will be disqualified. The Promoter reserves the right to disqualify any Entrant suspected of such activity.

20. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees provided under the Australian Consumer  Law as well as any other implied warranties under similar consumer production laws in the States and Territories of Australia (‘Non-Excludable Guarantees’).

21. Except for any liability that by law cannot be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, and agents), excludes liability for loss or damage, including indirect, special or consequential loss or damage, arising in any way from (a) technical difficulties or equipment malfunctions beyond the Promoter’s control; (b) the unauthorised access or third party interference; (c) entries of prize claims that are late, lost, altered, damaged, or misdirected for reasons beyond the Promoter’s control; or (d) use of a prize. The Promoter’s liability is limited to the maximum extent permitted by law.

22. All Entrants consent to the Promoter collecting their personal data in the course of the Competition and that the Promoter may use your personal data disclosed for the purpose of running this Competition, including disclosing your personal data to its related bodies corporate (as defined in the Corporations Act 2001 (Cth)). The Promoter will handle all Entrant’s personal data in accordance with the Privacy Policy (‘Privacy Policy’) which can be found at: https://thegrounds.com.au/privacy-policy/.

23. The Terms and Conditions are governed by the laws of New South Wales, Australia. Each entrant irrevocably agrees that the courts of New South Wales shall have exclusive jurisdiction over any action, proceedings or disputes arising which may arise out of or in connection with the Competition or these Terms and Conditions.

24. This Competition is in no way sponsored, endorsed, or administered by, or associated with Facebook, Instagram, TikTok or any other social media platforms. Entrants understand that they are providing their information to the Promoter and not to Facebook, Instagram, or TikTok. The information an Entrants provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments, or complaints about this promotion must be directed to the Promoter and not to Facebook, Instagram, or TikTok. Facebook, Instagram, or TikTok will not be liable for any loss, damage, or personal injury which is suffered or sustained by an entrant, as a result of participating in the Competition (including taking/use of a prize), except for any liability which cannot be excluded by law.
